snickers, copyright and your clay food sculptures

Hello fellow polymer people! I have been seeing this for awhile and just had to open my mouth. I noticed a lot of people replicating 'OREO's or using brand names such as Snickers, M&M's and Reeses Peanut Butter cups to name a few. To make a charm to keep for yourself is one thing but to sell something using a brand name is copyright. You are making a profit off of a name that is not your own. It may sound stupid, but even though you sculpted the clay to make it look just like a Reeses cup or an Oreo the actual company has nothing to do with it and you are making a profit by using their name. (Even though you have awesome skills and I am sure and they would be impressed by your sculpting skills, you may want to change your titles to avoid any conflict you may or may not have.) What are the odds? you might say, but you might be surprised what a major company would do. Even if it's just you on Deviant art or Etsy it is still copyright. Bottom line is just be careful how you word things. Feel free to contact me if you have anything to say regarding this matter or anything else!
